Haviva connects property owners and tenants on a single, secure, AI-powered platform — enabling rent management, tenant verification, document storage, intelligent chatbot assistance, payment processing, and community management. Haviva operates on behalf of its registered entity and is powered by an AI-driven team and automated systems.

Acceptance of Terms
By downloading, installing, registering for, or otherwise accessing or using the Haviva mobile application or website, you ("User") confirm that you have read, understood, and agree to be legally bound by these Terms & Conditions ("Terms"), together with our Privacy Policy and any additional guidelines or policies referenced herein.
These Terms constitute a legally binding agreement between you and Haviva. If you do not agree to these Terms in their entirety, you must immediately cease use of the App and website and uninstall the application.
Definitions
The following defined terms apply throughout these Terms:
- "App" — The Haviva mobile application available on Android and iOS platforms.
- "Platform" — Collectively, the App and the Haviva website (www.haviva.net).
- "User" — Any individual who accesses or uses the Platform in any capacity.
- "Owner" — A User who registers as a property owner, subject to admin approval, and uses the Platform to manage properties and tenants.
- "Tenant" — A User whose account is created by an Owner, who accesses the Platform to view property information, pay rent, manage documents, and communicate with their Owner.
- "Services" — All features, tools, and functionalities offered through the Platform, including rent tracking, tenant management, AI chatbot, FCS document scanning, notifications, and community features.
- "Content" — Any data, text, documents, images, or information uploaded to or generated on the Platform.
- "AI Features" — AI-powered capabilities including the chatbot (RAG engine), Vector Database search, and FCS (Full Content Scan) document intelligence.
- "Haviva" — The company operating the Platform, its successors, and assigns.
Eligibility
To use Haviva, you must meet all of the following eligibility requirements:
- Be at least 18 years of age
- Be accessing and using the Platform from within India
- Provide accurate, current, and complete registration information
- Not be barred from receiving services under applicable Indian law
- Not have previously had a Haviva account suspended or terminated for violations
Owners additionally require successful admin review and approval before their accounts are activated. Haviva reserves the right to reject any Owner registration at its sole discretion without providing a reason.
Tenants are onboarded exclusively via invitation by an approved Owner. Tenants may not self-register on the Platform.
User Accounts
Owner Accounts:
- Owners register via the App and are subject to admin approval before activation.
- Owners are responsible for the accuracy of all tenant information they input.
- Owners may create, manage, and remove Tenant accounts within their properties.
- Owners must not use another person's identity or create fraudulent property listings.
Tenant Accounts:
- Tenants receive login credentials by email from their Owner via the Platform.
- Tenants must update their password upon first login.
- Tenants are responsible for maintaining the confidentiality of their credentials.
- Tenants may not transfer or share their account with any other person.
Account Security:
- All Users are responsible for maintaining the confidentiality of their login credentials.
- Users must notify Haviva immediately of any unauthorized access at [email protected].
- Haviva is not liable for loss or damage arising from unauthorized use of your account due to your failure to maintain security.
Services Provided
Haviva provides the following core services through its Platform:
- Property Management: Tools for Owners to manage properties, assign units, set charges, and track rent
- Tenant Management: Secure onboarding, profile management, document storage, and communication
- AI Chatbot & RAG Engine: Intelligent assistant powered by a Vector Database and Retrieval-Augmented Generation, providing document-grounded answers about tenancy, charges, and community rules
- FCS — Full Content Scan: AI-powered document scanning for rental agreements, ID documents (Aadhaar, Driving Licence, Company ID), and rent payment statements
- Payment Processing: Web subscription billing via Cashfree; in-app payment tracking and records
- Notifications: Push and email notifications for payment reminders, service requests, and community updates
- Community Features: Events, neighbour introductions, service requests, and activity logs
Subscriptions & Payments
Owner Subscription Plans: Owners may access Haviva under the following subscription tiers: Starter (free), Smart (₹499/month), Prime (₹749/month), and Elite (₹999/month). Plan features and limits are as described on the Platform and subject to change with prior notice.
Payment Processing: Subscription billing for web-based purchases is processed by Cashfree Payments India Pvt. Ltd., a PCI-DSS certified payment gateway. Cashfree's terms of service and privacy policy apply to all transactions. Haviva does not store any card or bank credentials on its servers.
Rent Payments: Rent payments made by Tenants are processed through the Platform's payment integration. Haviva records the transaction status; the actual funds transfer is governed by the payment provider's terms.
- Subscription fees are non-refundable unless required by applicable Indian consumer protection law.
- Haviva reserves the right to modify pricing with at least 30 days' advance notice to active subscribers.
- Disputes between Owners and Tenants regarding rent payments must be resolved directly between the parties. Haviva is not liable for incorrect rent data entered by Owners.
- Failed payments may result in temporary loss of access to premium features.
Acceptable Use
You agree to use the Haviva Platform only for its intended and lawful purposes. Specifically, you agree that:
- All information you provide is accurate, truthful, and up to date
- You will use the Platform in compliance with all applicable Indian laws and regulations
- You will treat other users with respect within community features
- You will use the AI chatbot only for lawful, property management-related queries
- You will upload only genuine, unaltered documents for verification
Prohibited Activities
The following activities are strictly prohibited on the Haviva Platform. Violations may result in immediate account termination and, where applicable, referral to law enforcement authorities:
- Providing false, misleading, or fraudulent information during registration or use
- Impersonating any individual, Owner, Tenant, or Haviva staff member
- Creating fraudulent property listings, fake tenants, or fictitious transactions
- Uploading forged, altered, or fraudulent identity documents
- Attempting to hack, exploit, or circumvent the Platform's security systems
- Reverse engineering, decompiling, or disassembling any part of the App or backend
- Using automated scripts, bots, or scraping tools against the Platform
- Uploading viruses, malware, or any harmful code
- Harassing, threatening, or abusing other users via any Platform communication feature
- Using the Platform for any purpose that violates Indian law, including the IT Act 2000 or DPDPA 2023
- Misusing another user's personal information accessed through the Platform
- Attempting to access data or accounts that are not yours
Intellectual Property
All intellectual property in and associated with the Haviva Platform is owned exclusively by Haviva and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and applicable Indian and international intellectual property law. This includes, without limitation:
- The Haviva name, logo, brand identity, and trade dress
- All application source code, backend APIs, and database architecture
- All UI/UX designs, screen layouts, and visual components
- AI models, Vector Database structures, RAG configurations, and FCS engine
- All written content, documentation, and marketing materials
You are granted a limited, personal, non-exclusive, non-transferable, revocable license to use the App solely for its intended purpose as described in these Terms. This license does not permit you to copy, modify, distribute, sell, sublicense, or create derivative works from any part of the Platform.
User Content: By uploading Content to the Platform (e.g., ID documents, messages, profile information), you grant Haviva a limited, non-exclusive license to store, process, and display that Content solely to provide the Services to you. You retain ownership of your Content. Haviva will not use your uploaded documents or personal data for any purpose other than delivering the Services.
AI Features & Limitations
Haviva integrates advanced AI capabilities including the RAG-powered chatbot, Vector Database search, and FCS document scanning. By using these features, you acknowledge the following:
- AI Answers Are Not Legal or Financial Advice: Responses from the AI chatbot are generated based on your tenancy documents and community data. They do not constitute legal, financial, or professional advice and should not be relied upon as such.
- FCS Verification Is Supportive, Not Conclusive: FCS document scanning is an AI-assisted tool designed to support identity verification. It does not replace the legal obligation to perform proper due diligence. Owners remain responsible for verifying tenant identity.
- AI Accuracy: While we strive for accuracy, AI-generated outputs may occasionally be incomplete or incorrect. Haviva is not liable for decisions made based solely on AI chatbot responses.
- No Data Retention for Chatbot Queries: Queries submitted to the AI chatbot are processed to generate your response and are not retained or used for any secondary purpose.
Data & Privacy
Your use of the Platform is also governed by Haviva's Privacy Policy, which is incorporated into these Terms by reference. By accepting these Terms, you also accept the Privacy Policy in full.
Haviva processes personal data in compliance with the Digital Personal Data Protection Act, 2023 (DPDPA). All personal data is stored encrypted at rest using AES encryption and AES-256-CBC for financial data, transmitted over TLS/HTTPS, and stored on a dedicated secure server in Germany.
Disclaimers
The Haviva Platform and Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, Haviva makes no warranties, express or implied, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- That the Platform will be error-free, uninterrupted, or free from defects
- That any AI-generated content, document scan results, or chatbot responses will be accurate, complete, or reliable
- That the Platform will be compatible with all devices or operating systems at all times
Haviva does not warrant or take responsibility for any third-party services (including Cashfree, Mailgun, Cloudflare, or native map applications) used in connection with the Platform.
Limitation of Liability
To the fullest extent permitted by applicable Indian law, Haviva and its directors, employees, agents, affiliates, and AI systems shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, goodwill, or business opportunities
- Disputes between Owners and Tenants, including rent disagreements or eviction disputes
- Errors or inaccuracies in rent data entered by Owners
- Fraudulent documents uploaded by users
- Unauthorized access to accounts arising from a User's failure to secure credentials
- Service interruptions, data loss, or server downtime
- Decisions made based on AI chatbot outputs or FCS scan results
- Failures or errors attributable to third-party payment processors or service providers
In any event, Haviva's aggregate liability to any User for any claim shall not exceed the amount paid by that User to Haviva in the three months preceding the claim.
Indemnification
You agree to indemnify, defend, and hold harmless Haviva, its affiliates, officers, agents, and AI team from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your use or misuse of the Platform or Services
- Your violation of these Terms or any applicable law
- Your infringement of any third-party intellectual property or privacy rights
- Any Content you upload to the Platform that is false, fraudulent, or unlawful
- Any dispute between you and another User of the Platform
Suspension & Termination
Haviva reserves the right to suspend, restrict, or permanently terminate any User account at its sole discretion, with or without notice, for any of the following reasons:
- Violation of these Terms or the Privacy Policy
- Providing false or fraudulent registration information
- Engaging in any Prohibited Activity as listed in Section 9
- Non-payment of applicable subscription fees
- Conduct that is harmful to other Users, Haviva, or the Platform
- Legally required to do so by court order or government authority
Users may terminate their own accounts at any time by submitting a deletion request to [email protected]. Termination does not relieve you of any obligations or liabilities incurred prior to termination.
Third-Party Services
Haviva integrates with third-party services to deliver its full feature set. Haviva does not control these services and is not responsible for their performance, availability, or data practices. By using Haviva, you acknowledge that your use of these services is also subject to their respective terms:

Governing Law
These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Republic of India, including but not limited to:
- The Information Technology Act, 2000 and its amendments
- The Digital Personal Data Protection Act, 2023 (DPDPA)
- The Indian Contract Act, 1872
- The Consumer Protection Act, 2019
- The Copyright Act, 1957
- The Arbitration and Conciliation Act, 1996
These Terms explicitly exclude the application of the United Nations Convention on Contracts for the International Sale of Goods.
Dispute Resolution
Step 1 — Informal Resolution: In the event of any dispute, claim, or controversy, you agree to first contact Haviva at [email protected] and make a genuine effort to resolve the matter informally. Haviva will respond within 30 days.
Step 2 — Arbitration: If the dispute is not resolved informally within 60 days, it shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Chennai, Tamil Nadu, India. The proceedings shall be conducted in English.
Step 3 — Courts: For matters not suitable for arbitration (including injunctive relief, intellectual property disputes, or enforcement of arbitral awards), the exclusive jurisdiction shall vest in the courts of Chennai, Tamil Nadu, India.
Amendments to Terms
Haviva reserves the right to modify these Terms at any time. When we make changes:
- The updated Terms will be published at www.haviva.net/terms.html with a revised Effective Date
- For material changes, we will notify Users via in-app notification or email at least 14 days before the changes take effect
- Your continued use of the Platform after the effective date constitutes your acceptance of the revised Terms
- If you do not agree with amended Terms, you must stop using the Platform and request account deletion
Severability & Entire Agreement
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be deemed modified to the minimum extent necessary to make it enforceable. All remaining provisions shall continue in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Haviva with respect to your use of the Platform and supersede all prior agreements, representations, and understandings.
Haviva's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
